GENERAL CONTRACTUAL CONDITIONS

These general terms and conditions of contracting, together, where applicable, with any specific terms and conditions that may be established, will expressly regulate the commercial relations between FERROGÓN METAL, S.L.U. (hereinafter, HOTFIREDOOR) and the customer who contracts products and/or services offered through this website.

Customers are hereby informed that HOTFIREDOOR reserves the right to modify these general terms and conditions of service at any time, as well as any specific terms and conditions that may be established, respecting in all cases the general terms and conditions in force at the time the customer enters into the contract. In any case, after any modification, addition, and/or replacement, the customer's acceptance will be required.

Please note that the customer is subject to these general terms and conditions, along with any specific terms and conditions that may be established, in effect at the time of each transaction. Acceptance of these terms and conditions, or any specific terms and conditions, is required for the purchase of products and/or services. The validity of the general terms and conditions, and any specific terms and conditions, coincides with the time they are displayed on this website, and in all cases, respects any previous terms and conditions accepted by the customer at the time of purchase. New general terms and conditions, or specific terms and conditions, will apply from the moment they are made available to the customer through this website.

These terms and conditions have been drawn up in accordance with the provisions of Law 34/2002, on information society services and electronic commerce, Law 7/1998 on General Contract Terms, Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 7/1996 on the Regulation of Retail Trade and any other applicable legal provisions.

By accepting the general conditions, the client declares that they know and accept the procedures set out here as necessary to proceed with the contracting of products and/or services, which become binding.

In the event of any conflict between the general and specific terms and conditions, the specific terms and conditions shall prevail. For all other clauses that do not present any incompatibility, the provisions of the general terms and conditions shall apply.

  1. Contracting parties

The electronic contracting process through the website www.puertasparachimeneas.com will be carried out between the client and HOTFIREDOOR.

Those consumers who are natural persons, of legal age (over 18 years old), resident in the territory of the European Union and with their tax domicile in this territory, or legal entities that prove their status and accept these terms and conditions, and, where applicable, the specific terms and conditions that apply, will be considered "clients" of this website. The contracting of services and products by minors, users who do not legally reside in the European Union, as well as by those users who do not comply with the general or specific terms and conditions or when current legislation prohibits it, is expressly prohibited.

  1. Pre-employment information

All customers can view all products offered for purchase on the website, categorized by type and subcategory. Access to this website is free, and prior registration is not required to view the products and/or services displayed. By clicking on each product, the customer can access a complete product page, which includes a brief description, availability, available discounts, price, specifications, shipping options, in-store pickup options, and product images. Customers are advised that all product descriptions are based on information provided by the suppliers.

All prices are shown in euros and include applicable VAT and/or any other applicable taxes. These prices will always be current, except in the case of obvious typographical errors. Shipping is not included in the prices shown for the products; its cost will be itemized separately at checkout.

  1. Phases of the contracting procedure

The procedures for purchasing products will be those displayed on screen at any given time and described in these General Terms and Conditions. Customers may register as HOTFIREDOOR members during the purchase of products and/or services. They may also enjoy promotional benefits if any promotions are currently in effect. Similarly, customers are offered a purchase method that does not require HOTFIREDOOR registration, which only requires an email address.

To purchase products and/or services, the customer must validate the shopping cart, which will display all selected products and/or services, the number of units, the price, the delivery time, and shipping costs. The user can modify the contents of the shopping cart as they select new products and/or services. The customer can preview the shopping cart with the selected products and/or services pending payment in the upper right corner of the website. If the customer wishes to view their order in more detail, they can validate the shopping cart as many times as necessary. From there, they can choose to continue selecting items or confirm their order.

If you select in-store pickup, please specify the store where you wish to collect the product and/or service. Please note that all products and/or services are subject to stock availability at the time of collection.

The customer, through the shopping cart screen, can use any discount voucher or gift card that HOTFIREDOOR has given them as part of a promotion, prize draw, or other circumstance. To validate it, they must click on “Coupons” and the discount will appear in the price breakdown, provided it is still valid according to these general terms and conditions or, where applicable, the specific terms and conditions.

Once the customer has validated the shopping cart, they must complete the requested information and select, if applicable, the delivery and billing address, shipping method, and preferred payment method. They must also accept these general terms and conditions by checking the appropriate box. If this box is not checked, this website will not allow the customer to proceed with the purchase.

Payment System

Payment can be made by credit card, PayPal, or bank transfer. The customer can choose their payment method after providing their billing and, if applicable, shipping information. Payments are subject to the following conditions:

  • Payment by bank card will be processed through a payment gateway managed by a bank using a secure server certified according to the SSL protocol. The bank details entered are encrypted and securely transmitted to the bank's services and subsequently verified with the issuing bank to prevent fraud and misuse. HOTFIREDOOR does not have access to the bank details or information about the bank card used by the customer to complete the transaction.

  • All payment methods offered by HOTFIREDOOR are subject to verification and authorization by the payment issuing entities. If the payment entities do not authorize the payment, the contracting process cannot continue, the order will be canceled, and the purchase of the product and/or service will be considered void. Please note that the final price of the purchase, including any applicable shipping costs and taxes, will be charged at the time of purchase.

HOTFIREDOOR will send the customer an email summarizing the order within 24 hours of receiving payment. This email will serve as proof of purchase. The customer may request this proof of purchase at the HOTFIREDOOR store when collecting their order.

By accepting this legal text, the customer agrees to receive invoices related to the contract in electronic format. Should the customer require a paper invoice, they should send their request to the email address info@hotfiredoor.com or contact HOTFIREDOOR by phone at +34 93 692 45 60 or +34 644 777 969 (WhatsApp).

When the amount of a contract has been fraudulently or improperly charged using a bank card number, the customer will have the right to demand the immediate cancellation of the charge. However, if the contract was indeed entered into by the cardholder and the demand for a refund is not due to the exercise of the right of withdrawal or termination, the cardholder will be liable to the business for any damages incurred as a result of said cancellation.

  1. Shipping and collection procedure

Home delivery

Customers can select home delivery whenever it is available and subject to stock availability. We ship our products to the following countries:

Shipping costs are proportional to the weight, destination of the package, and shipping method, and will be borne by the customer. These costs will be displayed in the shopping cart before proceeding to checkout.

HOTFIREDOOR emphasizes the customer's responsibility to enter a complete and correct delivery address. Upon dispatch of the order, the customer will be notified of this, and the carrier will activate tracking functions to ensure delivery.

Orders will be shipped according to the products detailed in each Shipping Confirmation, within the timeframe indicated on our website, starting from the date of said Order Confirmation.

The delivery of the contracted products and/or services will generally be carried out respecting the following delivery deadlines:

  1. Estimated delivery times: The estimated delivery time may vary depending on the destination country.

    • Standard doors: 5–10 business days.

    • Custom-made doors: 30–40 calendar days

    • Custom-made ceramic glass: 3 to 7 business days.

    • Custom-made slat deflector: 30 to 40 calendar days.

    • Custom-made fireplace burner farm: 30 to 40 calendar days.

    • Barbecues: 5 to 10 business days.

    • Fireplace accessories: 5 to 10 business days.

The estimated delivery time may vary depending on the destination country.

Products that are out of stock or have been reserved as previously agreed are excluded from the general delivery timeframe. In such cases, the specific terms and conditions applicable to the order will apply.

In the event that we are unable to meet the estimated deadline, we will notify you of the circumstance and offer to set a new delivery date.

Likewise, delivery will be considered to have been made when you or a third party designated by you effectively take physical possession of the products, as evidenced by a signature on the delivery note or equivalent document, at the agreed address.

If delivery cannot be made, the transport company will deposit the order at its corresponding office and inform you of the location where you can collect it.

Orders will be properly packaged for transport. The risk of loss or damage to the products will pass to you upon delivery. Ownership of the products will also be transferred at that time. All shipments will be made via courier service.

Exceptions to delivery times:

During HOTFIREDOOR website special offers, delivery time may be longer than usual.

HOTFIREDOOR's holiday periods will be announced on the website and during the hiring process.

HOTFIREDOOR will not assume any responsibility for delays in the delivery of orders when this delay is solely the fault of the customer or the authorized person.

The customer assumes all risks of deterioration, damage, and loss of the products ordered from the moment of delivery, in accordance with the procedure outlined in these Terms and Conditions. The customer is responsible for the storage and preservation of the products under the conditions specified on their labeling.

  1. Right of withdrawal

Pursuant to the provisions of Article 102 of the Consolidated Text of the General Law for the Defense of Consumers and Clients, the client will have a period of up to fourteen (14) calendar days from receipt of the product to exercise his right of withdrawal, without indicating any reason.

To exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement to the address Carrer Santa Anna, 127, Cerdanyola del Vallès (Postal Code 08290 - Barcelona); or by email to info@hotfiredoor.com. You may use the model withdrawal form included in Annex 1 of these terms and conditions. In either case, HOTFIREDOOR offers the option of completing and submitting the withdrawal form electronically or through our website. If you choose to use the electronic form, you will receive an email confirming receipt of your request.

In the event of cancellation on your part, all payments received from you will be refunded. Return shipping costs are the responsibility of the customer. Returned products must be in their original condition (with their original packaging and unused). A copy of the invoice must be included. Before returning the product, the customer must ensure that it is properly protected and sealed to prevent damage during transit.

If the reason for the return is that the product is defective or does not match the order, HOTFIREDOOR will cover the return shipping costs and the cost of sending a replacement. If the reason is that you are not satisfied with the order, we will refund the purchase price, but not the return shipping costs. Additional delivery charges will also not be refunded if the customer expressly selected a delivery method other than the least expensive standard delivery option.

The refund will be issued without undue delay and in any event no later than fourteen (14) calendar days from the date on which the decision to withdraw from the contract has been effectively and unequivocally communicated, provided that the products and/or services being withdrawn have been received. Otherwise, the refund may be withheld until the products and/or services have been received or until the customer provides proof of their return.

The refund will be issued using the same payment method used for the original purchase.

Exercising the right of withdrawal will extinguish the parties' obligations to perform the contract.

Please note that the following are excluded from the right of withdrawal:

Based on the provisions of Article 103.c) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, you may not exercise your right of withdrawal on goods made according to your specifications or that are clearly personalized.

Also excluded from the right of withdrawal is any other product, good and/or service covered by article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.

Withdrawal policy for professionals not considered consumers

HOTFIREDOOR informs that if the user buys in their capacity as a professional without being considered a consumer, in relation to what is established in article 2 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws and what is included in the repeated doctrine, they will not be able to enjoy the right of withdrawal included in the previous section, since this only operates for consumer contracts.

  1. Product Warranty

When the purchased Product or Products present a lack of conformity because they do not correspond to the characteristics offered, present defects that prevent their normal use according to their nature, or do not offer the performance described for them, the Customer will have the right to the remedy of the purchased good within a period of three years from the date of contracting, as stipulated by Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, and under the conditions and with the means of proof regulated in the same legal text, without prejudice to the powers of the Point of Sale to verify the veracity of the defects, their origin and the time of their appearance.

Similarly, please be advised that the customer has the right to redress for defects in the goods, in accordance with the provisions of Article 120 et seq. of the Consolidated Text of the General Law for the Defense of Consumers and Users. In all cases, the regulations governing guarantees for the sale of consumer goods established by applicable legislation will apply. If the product is defective, HOTFIREDOOR will be responsible for replacing the product whenever possible, at no cost to the customer. If, due to availability issues, a replacement cannot be carried out, a full refund will be issued.

Purchase and sale made by professionals not considered consumers

In the event of a contract made by a company acting within the scope of its business or commercial activity, the buyer who, upon receiving the goods, examines them to his satisfaction, will not have the right to claim against HOTFIREDOOR alleging a defect or lack of quantity or quality in the goods, as stipulated in Article 336 of the Royal Decree of August 22, 1885, which publishes the Commercial Code.

The buyer shall have the right to claim against HOTFIREDOOR for any defect in the quantity or quality of the goods received baled or packaged, provided that he exercises his right of action within four days of receipt and the damage is not due to fortuitous event, inherent defect of the thing or fraud.

The buyer will have a period of thirty days following the delivery of the goods to make a claim based on internal defects of the thing sold in accordance with the provisions of article 342 of the Commercial Code.

Furthermore, the buyer is informed that he has the right to the remedy of the goods provided that the timely claim is made within the time limits established in this section, as stipulated in article 345 of the Commercial Code.

The customer is informed that the personal data requested to carry out the contracting of products and/or services of this website will be processed for the purpose of managing this contractual relationship, the timely provision of services, and its accounting, tax or administrative management.

Furthermore, you are informed that, pursuant to the provisions of section 2 of article 21 of Law 34/2002, of July 11, on information society services and electronic commerce, in relation to the provisions of letter b of section 1 of article 6 of the European Union Data Protection Regulation, your data will be processed for the purpose of managing the sending of commercial, promotional or advertising communications of our services and products, including the sending of Newsletters.

Personal data will be retained until it is no longer necessary or relevant for the purpose for which it was collected or recorded in our files. Afterward, personal data that meets this condition will be deleted, unless there is a legal provision that authorizes its retention. It should be noted that personal data will be deleted when the right to erasure is exercised, unless there is a legal provision that authorizes its retention.

Similarly, please note that the necessary personal data will be shared with the transport and logistics company responsible for delivering the product and/or service, should you select the home delivery option. Please also be advised that if you choose a payment option involving financing, you will need to provide your personal data to the corresponding bank in order to process the financing.

Otherwise, HOTFIREDOOR cannot be held responsible for its accuracy or for the performance of the services provided.

  1. Integrity and safeguarding of these general terms and conditions of contract

Each of the stipulations of these general terms and conditions, or, where applicable, the specific terms and conditions, shall be interpreted separately and independently of the others. Should any clause be deemed invalid or unenforceable under any legal provision, or be declared null and void by any court, tribunal, legal provision, or administrative authority, such invalidity shall only affect that clause and not the integrity and existence of the terms and conditions, with the remaining provisions remaining fully valid.

  1. Applicable law. Jurisdiction

These general conditions, and where applicable, the specific conditions, shall be governed by and interpreted in accordance with current Spanish legislation.

The parties expressly submit, for any issues or disagreements that may arise due to the interpretation, fulfillment and execution of this contract, to the jurisdiction and competence of the Courts and Tribunals corresponding to the client's domicile or to those of the place of fulfillment of the contractual obligation.

In the event of a contract made by a company acting within the scope of its business or commercial activity, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Barcelona (Spain).

  1. Information on online dispute resolution/consumer arbitration

Pursuant to Regulation (EU) 524/2013, applicable throughout the European Union, the European Commission provides an online dispute resolution platform, which HOTFIREDOOR makes available to customers of this website at the following link:http://ec.europa.eu/consumers/odr

Through this link, website customers can access the European Online Dispute Resolution (ODR) platform. If a customer has experienced a problem with an online purchase or service, they can use this platform to file a complaint related to the transaction or service, and opt for an out-of-court settlement of the dispute.
